Parents Rights

The reauthorization of the Individuals with Disabilities Education Improvement Act (IDEA), in 2004, retained important procedures which schools must use when evaluating eligibility for special education services, when developing or changing a child's Individualized Education Program (IEP) or when attempting to resolve serious disputes regarding special education issues. These procedures are sometimes referred to as "procedural safeguards" or "parent rights." The procedural safeguards specified in the IDEA were primarily designed to help schools and parents work together to develop effective educational programs for children with disabilities. The Notice of Procedural Safeguards must be provided in the native language or other mode of communication used by the parent [34 C.F.R. 300.504(d)].

Notice of Meeting and Prior Written Notice Sample Forms

Notice of Meeting and Prior Written Notice forms may be useful to school districts for providing parents with required notice of an IEP team meeting or prior written notice within a reasonable amount of time before the date the school proposes or refuses to initiate or change the identification, evaluation, educational placement of their child, or the provision of special education and related services (FAPE) to the child. These are model forms only; districts are not required to use these forms. The Prior Written Notice must be provided in the native language or other mode of communication used by the parent [34 C.F.R. 300.503(c)(ii).
