Title I Part D Subpart 2 - Delinquent Funds
Title I Part D Subpart 2 funding is to support education and training for students who are residents within a locally secured (or unsecured) detention center or correctional facility. Students who reside in eligible delinquent facilities are placed there by the courts due to adjudication or pre-adjudication in a criminal or civil court case.
Title I Part D Subpart 2 ARRA funds were distributed by formula. Kansas received $1,632,860 to support at least 1,595 students residing in delinquent facilities across the state during FY10 and FY11.

Local educational agencies (LEAs) with facilities that are licensed for neglected, abused, abandoned, and/or adjudicated and pre-adjudicated youth who are residents between the ages of 5-17. Only those LEAs with delinquent facilities which met the student enrollment minimum (37 students) were eligible to receive funding. In 2009-2010, there were a total of 25 eligible delinquent facilities within 26 districts that qualified and received Title I Part D ARRA funding.
Eligible LEAs completed Title I Part D ARRA Applications and submitted them to KSDE in September 2009. After approval of the applications, LEAs were able to utilize Title I Part D ARRA funds for eligible facilities within their district.
LEAs may spend funds for eligible facilities during 2009-2010 and 2010-2011. All funds must be obligated by September 30, 2011.
